How long do I have to make a medical negligence claim?

Hi

I went into hospital recently for an operation, but it didn't work and I got an infection which led to sepsis. I'm recovering now but I want to know if I can make a claim and how long I have to do it?

The claims limitation period for making a medical negligence claim is the same as the personal injury claims time limit. To break this down:

  • You have 3 years from the date of the negligent act to make a claim
  • Or 3 years from the date you obtained knowledge that you were suffering from an illness that you know was at least partially the fault of the defendant.
