I was hit while trying to merge with traffic and got hit, who is at fault?

Me and my family I were with were involved in a road traffic accident, it was a merging collision, we were the leading car into the lane which went straight and a guy who had to merge in hit us in the back side of our car.
We have all been suffering from back pain and I feel like the other driver is responsible but has disputed liability, can you tell me who is to blame?
Can I claim compensation for this accident?
